Abstract

Korisnici sve više koriste usluge s posebnom tarifom koje se ostvaruju putem javnih komunikacijskih usluga, a putem kojih žele dobiti određeni sadržaj u vidu nekog zabavnog sadržaja, savjeta, informacija i sl., koji plaćaju po povećanoj cijeni u odnosu na osnovnu uslugu. Kako bi korisnici usluge koristili na način da dobiju željeni sadržaj, a pritom se ne osjećaju prevarenima ili zakinutima po pitanju bitnih informacija o uvjetima i cijeni korištenja usluga, vrlo je važno uspostaviti osnovna pravila pružanja usluga, koje će stvoriti preduvjete za sigurno korištenje usluga. Ovaj specijalistički rad je podijeljen u više cjelina. Prvi dio odnosi se na općenito pojašnjavanje značenja i svrhe važnosti zaštite potrošača, a time i krajnjih korisnika javnih komunikacijskih usluga. Drugi dio obuhvaća definiranje problema, odnosno složenost usluga s posebnom tarifom i sudionika u pružanju usluge. Nadalje se govori o regulatornom aspektu koji je bio važeći dotad,a uz dio koji obuhvaća probleme promatrane upravo s korisničkog aspekta. Potom slijedi dio u kojem je prikazana nova regulacija, koja je posljedica upravo sustavnog praćenja prigovora korisnika i njena usporedba sa regulativom drugih država članica EU. Zaključni dio je posvećen analizi donesene regulacije i važnosti rada na informiranju korisnika o njihovim pravima i obvezama.

Abstract (english)

End users are increasingly using the premium rate services, which are providing through public communications services and through which they want to get some kind of content in the form of an entertainment content, advice, information, etc., which they pay at higher price in regard to basic service. In order for end users to use the service in a way to get the content they want without feeling cheated in terms of relevant information about the service terms and price, it is important to establish ground rules for service providing, which will create conditions for the safe use of services. This specialist work is divided into several sections. The first part refers to explanation of the general meaning and purpose of the importance of consumer protecting, and thus the end users of public communications services. The second part includes the definition of the problem and the complexity of premium rate services and participants in the provision of these services. Further there is a section on the regulatory aspect that was valid until then and the part that deals with the problems from the end user point of view. Then follows the part showing the new regulation, which is direct consequence of systematic monitoring of end users complaints and its comparison with the legislation of other states in the EU. The final part is devoted to an analysis of the new regulation and the importance of the consumer information about their rights and obligations.
