Abstract

Ovaj specijalistički rad uz pregled povijesti i najvažnijih pitanja mrežne neutralnosti i uvida u korištenje metoda upravljanja prometom na načine koji ugrožavaju neutralnost mreže, daje pregled zakonske regulative koja je relevantna za pitanja mrežne neutralnosti s posebnim naglaskom na novi europski regulatorni okvir iz 2009. godine i njegovu implementaciju u Republici Hrvatskoj. Prikazano je na koji način bi dodatne mjere iz novog regulatornog okvira u sudjelovanju s učinkovitim tržišnim natjecanjem trebale pomoći u rješavanju identificiranih problema mrežne neutralnosti i otvorenosti Interneta. Uz regulatorni okvir, posebno su analizirane smjernice koje je udruženje europskih regulatora BEREC donijelo i koje bi trebale poslužiti nacionalnim regulatorima u primjeni mjera poboljšane transparentnosti. U radu je prikazano aktualno stanje s primjenom metoda upravljanja prometom u Europi i Hrvatskoj. Primjenjivost predloženih mjera iz smjernica BEREC-a, regulatornog okvira i hrvatskih propisa analizirana je u svjetlu prikazane aktualne situacije u vezi pitanja korištenja metoda upravljanja prometom i pitanja mrežne neutralnosti. Kao rezultat analize prezentiran je prijedlog strategije pristupa pitanju mrežne neutralnosti za nacionalnog regulatora s prijedlogom mogućih mjera.

Abstract (english)

Beside the overview of the historic developments and the main network neutrality issues, this specialist's thesis presents the traffic management methods and the reasoning behind the usage of such traffic management methods that go against the network neutrality principles. Most important tools from the new European regulatory framework that can be used in the context of saving the network neutrality are discussed. Implementation of the European regulatory framework in Croatia is presented together with the analyis of the applicability of the BEREC's guidelines on transparency in Croatia. BEREC's guidelines on transparency were prepared with an aim to help national regulators in Europe in the application of the transparency measures. Analysis is supported with an overview of the situation in Europe and in Croatia with respect to the usage of the traffic management methods. As the result of the analysis a proposal for the national regulator on a strategy to preserve the open and neutral character of the Internet is formed and given.
