Abstract

Specijalističkim radom obuhvaćan je pregled europske i hrvatske regulative u postupku liberalizacije tržišta poštanskih usluga te zaštita prava korisnika poštanskih usluga, s osvrtom na e-trgovinu u dijelu koji se odnosi na dostavu. Tržište poštanskih usluga EU postupno se otvaralo konkurenciji, a RH je svoje zakonodavstvo postepeno usklađivala s pravnom stečevinom EU. Razvojem tržišta, zaštita korisnika usluga postala je jedan od prioritetnih ciljeva regulacije tržišta, a time i nacionalnih regulatornih tijela koji trebaju ustanoviti što djelotvorniji i kvalitetniji mehanizam zaštite prava korisnika usluga. HAKOM kao regulator imao je zanačajnu ulogu u zaštiti korisnika poštanskih usluga i u okviru svojih nadležnosti utjecao je na postojeću pravu regulativu i praksu kao i na prava i obveze i davatelja i korisnika poštanskih usluga. Korisnici e-trgovine vrlo su često i korisnici poštanske usluge, s obzirom da e-trgovina kao završnu fazu ima poštansku uslugu, odnosno dostavu pošiljke. Jačanjem e-trgovine prepoznati su problemi i manjkavosti regulative posebno u pogledu nedostatka nadzora na tim dijelom tržišta te manjkavosti zaštite korisnika. Stoga je EU donijela paket novih pravila kako bi se stvorilo sigurnije i uspješnije okruženje za korištenje usluga.

Abstract (english)

The specialized work includes a review of European and Croatian regulations in the process of liberalization of the postal services market and the protection of the rights of postal service users, with reference to e-commerce in the part related to delivery. The EU postal services market was gradually opening up to competition, and the Republic of Croatia was gradually aligning its legislation with the EU acquis. With the development of the market, the protection of service users has become one of the priority goals of market regulation, and thus of national regulatory authority that need to establish the most effective and high-quality mechanism for the protection of service users' rights. As a regulator, HAKOM played a significant role in the protection of postal service users and, within its competences, it influenced the existing legal regulations and practices as well as the rights and obligations of both providers and users of postal services. E-commerce users are very often also users of the postal service, since e-commerce has a postal service, ie package delivery, as the final phase. The strengthening of e-commerce has identified problems and shortcomings in regulation, especially in terms of lack of supervision in this part of the market and consumer protection. Therefore, the EU has adopted a package of new rules to create a safer and more successful environment for the use of services.
